A team comprising Messrs. Andy Lem – Partner, Litigation and Dispute Management Practice Group, S Suressh – Partner, Litigation Practice Group, Tan Chau Yee – Partner, Head of Construction, Engineering and Infrastructure Projects Practice Group and Huang Zhihao – Of Counsel visited BIAC Secretariat on 20 November 2019.

In a briefing session, the team was introduced to BIAC by Mr. Azizul Abedin – Chief Operating Officer, Sheba Networking Ltd., who coordinated with the parties to organise the meeting. Earlier he introduced his organisation Sheba Networking Ltd. and hoped that BIAC and Eversheds Harry Elias can work together in resolving commercial disputes in which his organisation will be acting as a catalyst. The meeting aimed at getting a basic understanding of the business and legal challenges foreign investors face in Bangladesh and explore opportunities of cooperation between Eversheds Harry Elias and BIAC.
Mr. Andy Lem and Mr. Muhammad A. Rumee Ali – CEO of BIAC, introduced their respective organisations. The parties shared their country experiences and the discussions were intensive which prompted both parties into considering critical aspects of promoting international commercial mediation and arbitration. The parties expressed their interest in developing the conversation and taking discussions further by entering into a Memorandum of Understanding.
Mr. Suressh suggested that Bangladesh can look into the model law under the Singapore Convention on Mediation for updating its Mediation Statutes. The Team offered to liaise with the Singapore International Mediation Centre (SIMC) so that BIAC can be benefitted from its best practices.
At the end of the meeting, the team went around different sections of the new premises of BIAC at Unique Heights. Eversheds Harry Elias team visited Bangladesh for the first time and dropped by to see for themselves the facilities of institutionalised ADR in Bangladesh. Mr. M A Akmall Azad – Director, BIAC talked about the legal challenges faced by foreign investors in Bangladesh and Ms. Rubaiya Ehsan Karishma – Counsel, BIAC delivered a short presentation on the emergence of BIAC activities and recent achievements.
